S. Baxter Jones again faces the threat of eviction by Fannie Mae at a court hearing on Thursday, July 18, at 9 am, in Jackson, MI.  After twice winning delays in the eviction in bankruptcy court with the support of dozens of people in the courtroom, Jones’ bankruptcy has been discharged and his case is back in the 12th District Court.

Fannie Mae, the owner of the mortgage loan on his home, and Wells Fargo, the mortgage loan servicer, have consistently refused to negotiate with Jones.  Jones qualifies for loan modification programs that were specifically designed for persons with disabilities in his situation.  Nevertheless, Fannie Mae and Wells Fargo refuse to even consider him for the programs.

Jones, a teacher in the Detroit Public Schools for 20 years, lives in Jackson County.    He suffered traumatic brain injury in 2005 and is now a person with severe disabilities.  Unable to work for almost two years,  Mr. Jones depleted his sick bank fund and life savings forcing him to return to work prematurely with an undiagnosed traumatic brain and spinal cord injury.  In 2010, the injury was finally diagnosed , and in April 2010, Mr. Jones received a family medical leave approved by Detroit Public Schools.  In July 2010 while on summer break, he was unjustly fired by DPS, which was under the control of Emergency Financial Manager Robert Bobb, because he could no longer fulfill his work related education and re-certification requirements!  And then he was denied his pension.

“I was a middle school teacher and coach at Fisher Middle School. I was active in the community. I worked with kids and it was my passion. Now I’m not being given the opportunity to stay in my home because of my unfortunate circumstances,” said Jones.

Jones has offered to pay current market value for his home, but Fannie Mae has yet to respond. Instead, Fannie Mae, a government-owned financial corporation, chooses to use taxpayer resources to cruelly throw a person with disabilities onto the streets.

“It was what I worked for. I love my home and I want to stay there,” said Jones.

In 2008, the Federal government took over Fannie Mae and Freddie Mac, in order to avert a complete collapse of the Wall Street Banks and the financial system. Fannie Mae and Freddie Mac create, buy and sell mortgage backed securities, controlling more than 60% of all mortgages and backing almost 90%of new mortgages in the U.S.   Fannie and Freddie guarantee these mortgages, which means that when a homeowner ges evicted, the banks and private investors lose nothing – the taxpayer picks up the tab.    To date, the taxpayers have covered about $188 billion in losses and the Federal Reserve has purchased more 1 trillion in mortgage backed securities and continues purchase $40 billion per month. This is $40 billion a month that goes directly to the banks and the 1%.  Despite the taxpayer support, Fannie Mae refuses to work with Jones.

Wells Fargo Bank, which foreclosed on Jones, received $36.9 billion in bailout funds and an unknown amount from the Federal Reserve’s $8 trillion emergency loan programs for Wall Street.  Yet, Wells Fargo has a poor record in working out loan modification programs for homeowners.  Furthermore, Wells Fargo, along with the other banks, refuse to pay the property taxes on many of the homes that they foreclosed on in Detroit, after throwing out the families!

Demand they stop the eviction of S. Baxter Jones and work with him to modify his loan with a principal reduction to current market value and a low interest rate so he can stay in his home.
